Dear Members,

The Business Preservation Law of 7 August 2023, which took effect on 1 November 2023, reshaped the Luxembourg restructuring and insolvency landscape by introducing a genuine alternative to bankruptcy. It offers new procedures for out-of-court arrangements and judicial reorganizations tailored for companies encountering financial difficulties. 

Debtors and creditors alike have seized the opportunity to initiate non-bankruptcy proceedings which have generated significant case law. Key rulings are published in our “Bulletin Droit & Banque” of December 2024, featuring commentary by Me Nicolas Bernardy.

To bring this case law to life for our members, Clifford Chance, who acted as legal counsel on major judicial reorganization cases, kindly agreed to share their insights.  The Luxembourg courts have already decided on critical legal questions, such as the scope of the Business Preservation Law, the conditions of a court ordered transfer of assets, creditors' standing depending on their class and the incidence of restructuring & insolvency proceedings opened abroad.

Our expert speakers will guide us through the legal and tactical dimensions of high-profile cases, providing invaluable insights for all attendees.

Certificate of attendance: Participants who sign the register on premises will receive a certificate of attendance. As ALJB has been accredited by the Luxembourg Bar as a training organisation, members of the Bar can use this certificate of attendance to comply with their continued training obligation.

Parking and public transport: There is no parking available at the venue. The closest parking is Monterey. The nearest tram stops are "Stäreplaz / Etoile" and “Hamilius”, which are a 10 minutes’ walk from the venue.
